Danville middle school teacher, cheerleading coach arrested for allegedly sexually assaulting girl, sending obscene video

DANVILLE — A 41-year-old man who works as a cheerleading coach and middle school teacher has been arrested on suspicion of molesting a teen student and sending her an obscene video, according to court records.

Nicholas Moseby, of Concord, was arrested this week on suspicion of committing a lewd act against a 15-year-old girl, sending obscene material to a minor, and unlawfully communicating with a minor. Contra Costa prosecutors are expected to file felony charges against Moseby sometime this week.

Moseby was arrested after the parents of his alleged victim reported to police that he sent her a video on Snapchat of himself masturbating. The girl allegedly replied with shock and deleted him from her friends list. Police say the communication came days after Moseby added her as a friend and “apologized in advance” during a cheerleading practice for sending her a picture of his genitals.

During an interview, the girl told police Moseby inappropriately touched her during a workout, according to court records.

Moseby worked as a biology teacher for Diablo Vista Middle School in Danville and taught at San Ramon Valley High School in 2021, according to public records. He also worked as a cheerleading instructor for Nor Cal Elites, a private youth cheerleading instruction organization that strives to provide “positive encouragement, safe instruction, and overall fun experiences for athletes and parents,” according to its website.

Moseby was placed on leave after his arrest, according to an email circulated to parents from the San Ramon Valley Unified School District. The email pledges to provide an update if and when Moseby is charged.

“Student safety is always our top priority, and we will be focusing on supporting students and families,” Illana Samuels, communications director for the school district, said in an email to this news organization.

A spokeswoman for Nor Cal Elites wrote in an email to parents that Moseby was fired immediately after the company learned of his arrest.

“We are shocked and appalled by the allegations and arrest of Nicholas Moseby. We have and will fully cooperate with law enforcement regarding this matter,” Donna Potter said in an email to this news organization. “We take this very seriously and once we heard of his arrest we took swift and appropriate action to release him from employment with our company. We do not tolerate any inappropriate, unsafe, or illegal behavior from our staff especially when it concerns our students.”

Moseby is being jailed in lieu of $200,000 bail and has not yet been given an attorney, according to court records.

Police say that Moseby has a prior arrest for allegedly furnishing alcohol to a minor in Arizona, which should have disqualified him from becoming a teacher, except that it failed to show up in a background check. Investigators say Moseby wasn’t fingerprinted after the 2009 arrest, which led to the incident not appearing when school officials ran Moseby’s fingerprints after he applied for a job.

The prior arrest stemmed from a New Year’s Eve party in Gilbert, Arizona where Moseby allegedly bought alcohol at a Walmart for a 17-year-old girl who was friends with Moseby’s girlfriend at the time, an 18-year-old high school student who attended the school where Moseby worked. The 17-year-old reported to police the Moseby’s roommate at the time sexually assaulted her at the party after she’d become intoxicated. Moseby, who was then in his late 20s, was never charged and denied the allegations, court records show.

The recent allegations against Moseby arose on Sept. 6, when the alleged victim’s parents called police to report the Snapchat video. The girl said that Moseby sent her messages on Snapchat, followed by innocuous videos of the gym where they held cheerleading practices. Later, he allegedly asked her for a pictures of herself in pajamas, so she sent him a picture of herself wearing a hooded sweatshirt.

He allegedly responded with a message that said, “booty?” She interpreted that to mean he wanted a picture of her butt, she would later tell police. During the same interview, she told authorities Moseby rubbed her butt for “about 60 seconds” during a cheerleading practice. She said she cut off communication with him after receiving the lewd video.

Police served search warrants at Moseby’s home and seized a thumb drive, his cellphone, an iPad, and other electronic devices, court records show. A review of those items is still underway.
