A doctor has been ordered to pay child support to a couple until their baby turns 18 after botching a vasectomy on the father.

The couple in Medellin, Colombia – who have not been named – were stunned to discover that the man had got the woman pregnant after he underwent a vasectomy at a health clinic.

The dad had decided to have the procedure in 2012 to avoid having more children with his wife because they did not have enough income.

He even underwent an examination at the clinic to ensure that the vasectomy had been effective, with the clinic confirming that it had.

But after discovering that his wife was pregnant, the couple, who already had two children, took the doctor and the health clinic to court in 2017.

And now after a lengthy legal battle during which the parents argued that they had unwillingly become parents again on October 1, 2013 due to an incorrect medical procedure, the judge has ruled that the doctor and the health authority in charge of the clinic must pay court fees and child support 

These will total COP 295 million (GBP 52,680) until the baby turns 18. 

Now, the couple’s daughter is almost ten years old, according to reports. As a result, the doctor will has to pay eight more years of financial support.

The Superior Court of Medellin also ruled that the health clinic and the doctor must pay 80 instalments of the Colombian minimum wage.

This totals approximately COP 92 million (GBP 16,430) and COP 143 million (GBP 25,535) for maintenance, as well as COP 60 million (10,715) for the lawsuit costs.

‘As a result of this unexpected conclusion, the patient was not recommended to continue using contraceptive methods to avoid the risk of pregnancy,’ the court ruling read, according to the court ruling.

‘When it was proven that the parents did not want to procreate more children, it was concluded that there was an impact on their life projects that had repercussions in the immaterial field, especially considering the precarious economic situation of the father, who currently cannot work due to their health problems.’

In December, in his first ruling, the Judge said that the botched vasectomy not only caused ‘harm in the exercise of sexuality and reproductive freedom’ of the couple, but ‘considerably affected the economy of the family nucleus and it has generated worries and afflictions for the plaintiffs, since they have no way to meet the basic needs of the minor.’

According to Infobae, a Spanish-language news site based in the US, the father suffers from a debilitating condition called severe bilateral hearing loss.

This makes it extremely difficult for him to work, the report says.

He experiences frequent doziness and vomiting and must wear a hearing aid.
