Nurse allegedly worked while Covid positive

A nurse has been charged with allegedly placing others in danger of serious injury after working at an aged care facility while infected with Covid.

WorkSafe alleges the Victorian nurse attended multiple casual work shifts at the facility between July 26 and August 2 in 2020 after being advised not to.

The nurse was then allegedly made aware she was Covid positive.

She is charged with recklessly placing or potentially recklessly placing another person in danger of serious injury by attending work after returning a positive PCR test. The offence carries a maximum penalty of five years’ jail and a $297,396 fine.

The nurse is further charged with failing to take reasonable care for the health and safety of persons at the workplace by attending work after being advised not to, an offence drawing a maximum fine of $297,396.

It’s not alleged the nurse’s actions led to Covid spreading in the workplace.

The matter is listed for a filing hearing at Moorabbin Magistrates’ Court on September 7.

WorkSafe said other investigations relating to the control of Covid-related risks in workplaces remain ongoing.
