But what about if you’re the passenger involved in a collision? What benefits do you have access to — and more importantly, whose insurance provides them?
Coverage for passengers depends on if they have their own auto insurance policy
If you’re injured as a passenger in a motor vehicle collision, making a claim can be confusing.
The good news is even if you’re someone who doesn’t drive, you’re protected.
“No one is left out in the cold with no coverage if you are injured involving a motor vehicle incident,” says a representative for Hamilton-based law firm Findlay Personal Injury Lawyers. “Regardless of not having insurance yourself.”
According to the Insurance Bureau of Canada, passengers injured in a collision in Ontario “have access to the Statutory Accident Benefits (SABS) , and the claims should be made in the following order of priority:

What benefits can I access as a passenger involved in a collision?
As an injured person, including as a passenger, you may be entitled to the following benefits:
- Income replacement: This compensates you for a percentage of income loss.
- Caregiver: This provides compensation for expenses incurred when you cannot carry on as the main caregiver for a member of your home who requires such care.
- Non-earner: This will provide compensation if you are fully unable to continue living a normal life but do not qualify for an income replacement benefit or caregiver benefit. Full-time students or recent graduates who are unemployed may be eligible for this benefit.
- Rehabilitation: This covers any rehabilitation expenses encountered when you are injured and require rehabilitation.
- Attendant care: This will cover some of the care costs of an aide.
- Medical: This covers medical expenses incurred when you are injured.
- Compensation for other expenses: These benefits will cover other expenses such as the cost of family visits during any treatment you’re taking or during your recovery time. It may also pay for any housekeeping duties and some lost educational expenses.

If you die as a result of the collision, members of your family may be entitled to the following benefits:
- Death benefit: This pays money to your family members, including your spouse and dependents.
- Funeral benefit: This will cover some of the funeral expenses.
